1. Simulated Trading Environment
FundedSmart provides simulated trading evaluation challenges only. No real funds are traded, deposited, or held in evaluation accounts. Any funded-stage account remains a funded-stage simulated account using virtual funds.
Key characteristics:
- Prices, market data, and execution conditions are simulated and may differ from live markets
- Slippage, spread, liquidity, and timing may differ from live markets
- Simulated performance is not indicative of future live-market results
- No actual financial instruments are bought, sold, or held through FundedSmart evaluations
2. No Financial Advice
Nothing on FundedSmart constitutes financial, investment, legal, or tax advice, or a solicitation to trade in real markets. Participation is at your own discretion and risk. Decisions to buy, sell, hold, or trade securities or other instruments in live markets involve substantial risk of loss and are best made with advice from qualified professionals where appropriate.
3. No Guarantee of Profits, Progression, or Rewards
There is no guarantee of profits, successful evaluation outcomes, progression to a funded-stage simulated account, or rewards. Rewards are discretionary and governed by the Rewards Policy.
4. Fees and Loss of Service Fees
Challenge fees are service fees for access to evaluation infrastructure — not deposits or investments. After activation, fees are generally non-refundable except as described in the Refund & Cancellation Policy. You may lose the entire service fee if you fail criteria, breach rules, do not trade, or stop participating.
Payment purpose: Payments collected for FundedSmart are for simulated evaluation and related software/service access only. They are not deposits for live trading, brokerage capital, investment products, or trading tips.
5. Technology and Platform Risk
The Service depends on third-party technology providers (including our simulated trading platform), hosting, market data, and payment infrastructure. Outages, delays, latency, incorrect or incomplete data, or other errors may affect access and performance. The Company does not control all third-party uptime, data quality, or feature sets, and is not liable for losses arising from faulty, delayed, or unavailable data or platform interruptions, to the maximum extent permitted by law.
6. Hypothetical Performance
Hypothetical or simulated performance results have inherent limitations. No representation is made that any account will or is likely to achieve profits or losses similar to those shown in examples, marketing, Academy content, charts, pass-rate illustrations, or backtests. Simulated results are often prepared with the benefit of hindsight and do not involve the same financial risk as live trading. There are frequently sharp differences between hypothetical results and actual results subsequently achieved in live markets. Past simulated or hypothetical performance is not indicative of future results.
7. Testimonials and Marketing Claims
Testimonials, case studies, and marketing claims appearing on FundedSmart websites or materials may not be representative of other clients’ experience and are not a guarantee of future performance, evaluation outcomes, or rewards.
8. Regulatory Position
FundedSmart is not presented as a regulated brokerage or investment service. Consumer protections available for regulated financial services may not apply. Your account is not covered by investor compensation schemes typical of licensed brokers.
9. Jurisdiction
It is your responsibility to ensure participation is lawful where you live. Some jurisdictions may restrict simulated trading evaluation services.
10. Acknowledgment
By purchasing a challenge, you acknowledge that you:
- Understand the simulated nature of the environment (including funded-stage simulated accounts)
- Accept that service fees are generally non-refundable after activation, subject to the Refund Policy
- Understand that rewards are discretionary and not guaranteed
- Accept the risks in this disclosure, including technology, data, and hypothetical-performance limitations
- Are not relying on FundedSmart for financial advice or returns
